Certificate of Lawfulness
Not all development requires planning permission. The Government has given a range of minor developments that you don't need to apply for planning permission for. This is called permitted development. In additon some forms of development that would normally require permission are immune due to the length of time that they have subsisted. In both circumstances, it is possible to apply to the Local Planning Authority for a Certficate of Lawfulness. This procedure follows a similar route to a full planning application. The main benefit of ensuring that you have a Certificate of Lawfulness is when ownership of the property is transferred to another party there are no unnecessary delays in respect of planning matters.
There are two types of Certificates of Lawfulness; Certificate of Lawfulness for Proposed Development and Certificate of Lawfulness (Existing)
